What is in the best interests of the child?

I believe all children have the right to an adequate standard of living, health care, education and services. Children have the right to be raised in a home led by their “primary parent” as I feel the primary parent is in the best position to share empathy, emotional support and “life” advice with each child.  Children also have the right to enjoy a healthy relationship with both of their parents and extended family members. They have the right to a balanced diet, a warm bed to sleep in and protection from abuse, neglect, exploitation and discrimination.

These rights make up what I see as a child’s “best interests” in that placement in a home that affords the child the greatest percentage of these factors is a placement that sees to the “child’s best interests.”  It is easy for parents when caught up in a conflict to anchor their case on one or two of these factors that they feel best support their argument.  But the judge is charged to see the question of “best interests” in light of the whole picture…not just one or two issues no matter how important each parent feels that individual factor to be.
